Majestic Athletic, a division of VF Licensed Sports Group, LLC (“Majestic,” “we,” “us” or “our”) recognizes that you care how information about you is used and shared and respects your privacy. This Privacy Policy describes what information we may collect from you, how we collect that information, how we use that information, and the choices you have regarding your information. This Privacy Policy applies to the following products and services operated by Majestic:

  • the mobile application entitled “Swing IQ” (the “App”) that contains a link to this Privacy Policy;
  • Majestic’s sensor-enhanced athletic apparel (the “Swing IQ Product”); and
  • the functionality provided by the App and Swing IQ Product and the services and resources enabled or made available by Majestic via the Website.

For purposes of this Privacy Policy, the Site, the App and the Swing IQ Product are collectively referred to as the “Swing IQ Services.”

This Privacy Policy applies whether you are a “Visitor” (which means that you simply browse the Website) or you have a “Member Account” (which means that you have registered or transacted with the Swing IQ Services or a component thereof). By accessing, viewing and/or using the Swing IQ Services and/or providing us with information through the Swing IQ Services, you are indicating your consent to be bound by this Privacy Policy. This Privacy Policy was lasted updated April 17, 2017 and may be updated from time to time. Please check back periodically for further updates and changes.


Information You Provide

In order to access the data collected by the Swing IQ Product, you must download the App and create a Member Account. At that time, we ask for some personal information, including your name and email address. Your email address will be your Member Account user name, which you will use to log into your account. You may also create your Member Account using your login credentials from your Facebook or Google+ account. We will ask permission to access basic information from that account, such as your public profile information and email address, in accordance with the terms of use and privacy policy of such social networking site. You may change such permissions at any time.

As you use the Swing IQ Product to analyze your baseball bat swing, data (such as hand speed, hip and shoulder rotation, etc.) is collected by sensors in the Swing IQ Product and is transferred into storage in the App on your mobile device paired to the Swing IQ Product. If you sign up for and sync your mobile device with our additional cloud-based services then the data stored in your App is transferred from your mobile device to our servers. This data is stored and used to provide the Swing IQ Services and is associated with your Member Account. Each time data is transferred, we log information about the transmission, including the date and time, type of mobile device and its operating system and the version of the App.

We also collect and store information that you provide to us in our stores, through our customer service representatives, at events, through marketing efforts, including contests, sweepstakes and events, and through third parties, or any other way we interact with you. For example, if you contact us via email, we collect your name and email address along with any other content included in the email. We also collect certain requested information if you contact us via email regarding support for the Swing IQ Services so that we can provide you with assistance. You may choose not to provide certain information, but then you might not be able to take advantage of certain capabilities of this Website or other services we may offer.

When you buy from our store, we may request, collect and store some or all of the following types of personal information: name, billing address, shipping address, e-mail address, telephone number, and information about a third party you provide when we ship an order. We may also maintain a record of your product interest and purchases.

Automatically Collected Information

As is the case with most online services, we automatically collect and store certain other non-personally identifiable information automatically whenever you interact with us. For example, we may collect your Internet Protocol (IP) address and browser information and reference site domain name when you visit the Website and analyze this data for preferences, trends, and site usage statistics.

We may also collect information by using cookies, web beacons, and related technologies in order to analyze and understand how the Website is used and to enhance your visits to the site. We also may use third-party companies to serve advertisements (banners or links) on our behalf across the Internet. These companies use tracking technologies (including cookies and pixel tags) to collect non-identifiable information about your visits to our website and your interactions with our products and services in order to provide tailored advertisements based on your interests and browsing of our website (remarketing) on our behalf and on behalf of other advertisers across the Internet. We use third-party audience data (such as age, gender, and interests) to better understand and advertise to audiences that visit our Website. We do not use or associate personally identifiable information with remarketing lists, cookies, data feeds, or other anonymous identifiers.

The Website currently does not have a mechanism to recognize “Do Not Track” signals, but several of the third-party companies who utilize these cookies or beacons enable you to opt out of this advertising. Please note this does not opt you out of receiving marketing communications from us.

In addition, some of our email communications to you may include a “click-through URL” linked to a particular page on the Website.
